Terms of service

These terms are the agreement between you and Trailwise BV ("Trailwise", "we") for the use of the Trailwise service, including the web application, the iOS and Android apps, the AI coach Trailly, and the coach tools. By creating an account or using the service you accept them. If you are a coach, the coach terms apply in addition. If you are an organisation, your written agreement with us applies in addition.
1. Who can use Trailwise
You must be at least the digital consent age of your country of residence, as listed on the minimum age page, and never under thirteen. Below that age, only a parent or guardian may open and hold the account. You must give accurate information and keep your account to yourself: one person per account, no sharing of sign-in links.
2. Not medical advice
Trailwise provides training, recovery and nutrition guidance for information only. It is not medical advice, it is not a medical device, and it is not a substitute for a qualified professional. Always consult a doctor before making significant changes to your training or diet, and use the guidance at your own risk.
Trailwise flags what is worth a conversation. It does not diagnose, it does not treat, and it will tell you to see a professional rather than guess. If you have a medical condition, an eating disorder history, are pregnant, or are returning from injury, get clearance from a professional before following any plan.
3. Plans, trial and the free plan
Trailwise offers a free plan, a trial and paid plans. The trial lasts thirty days, needs no payment method and does not convert into a paid plan by itself. When it ends you choose a paid plan or your account becomes a free account; nothing you connected is lost. The features of each plan and the current prices are published on the pricing page and shown before you pay. Prices include VAT for consumers.
4. Payment, renewal and price changes
Paid plans are billed in advance, monthly or yearly, through Stripe. A subscription renews automatically at the end of each period until you cancel. You can cancel at any time from your settings; cancellation takes effect at the end of the current period and you keep access until then. If we change the price of your plan, the price you pay does not rise while your subscription is active. Any offer we make to new members is available to existing members on the same terms.
5. Right of withdrawal and refunds
If you are a consumer in the European Union or the United Kingdom, you have the right to withdraw from a first paid purchase within fourteen days without giving a reason. Because the service starts immediately, you agree that we begin providing it during that period, and if you withdraw you pay only for the days already used. To withdraw, write to support@trailwise.coach or use the model form below. After the withdrawal period, and for renewals, payments are not refunded, except where the law requires it or where we choose to refund because of a fault on our side.
Model withdrawal form: "To Trailwise BV, Wetteren, Belgium, support@trailwise.coach. I hereby withdraw from my contract for the Trailwise subscription ordered on [date]. Name, email address used for the account, date."
6. Your data and your connections
You own your data. You grant us the licence needed to store it, process it and show it back to you and to the coaches you choose, as described in the privacy notice. You can export everything and delete your account at any time from your privacy and data settings. You can also close your profile without deleting your data; we keep it for at least two years so you can come back. When you connect a third-party service, you also agree to its terms, and you confirm that you are allowed to bring that data to Trailwise.
7. Trailly and AI-generated content
Trailly is an AI coach. Its guidance is generated by a language model from your data and can be wrong, incomplete or out of date. It is marked as written by AI. You remain responsible for the decisions you take. The How Trailly uses AI page explains its limits.
8. Acceptable use
Do not use Trailwise to break the law or the terms of any connected provider; do not try to access, scrape or copy other people’s data; do not upload malicious files or content you have no right to; do not resell access or use automated tools to interact with the service without our written permission; do not use the service to build a competing product with data that is not yours.
9. Availability and changes
We work to keep Trailwise available and we tell you about planned maintenance in advance where we can, but we do not guarantee uninterrupted availability. Features change: we add, improve and sometimes remove them. If we remove something material from a paid plan we tell you in advance, and you can cancel.
10. Suspension and termination
You can end this agreement at any time by deleting your account. We may suspend or end your access with notice if you breach these terms, if we must do so to keep the service secure or to comply with a provider agreement or the law, or if we stop offering the service, in which case we refund any prepaid period you cannot use and give you time to export your data.
11. Intellectual property
Trailwise, Trailly, the software, the design and the coaching method are ours or licensed to us. You receive a personal, non-transferable right to use the service for as long as this agreement lasts. Feedback you give us may be used to improve the service without any obligation to you.
12. Liability
To the fullest extent permitted by law, Trailwise is provided as it is, and we are not liable for indirect or consequential loss, or for injury or loss resulting from training or dietary decisions taken on the basis of the guidance. Our total liability under this agreement is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under Belgian law, including our liability for fraud, intent or gross negligence, or your rights as a consumer.
13. Changes to these terms
We may update these terms. If a change is material, we update the version and effective date above and tell you by email or in the app at least thirty days before it applies. If you do not agree, you can cancel before the change takes effect. Continued use after that date means you accept the updated terms.
14. Governing law and disputes
These terms are governed by Belgian law. Disputes fall under the courts of the judicial district of the registered office of Trailwise, without prejudice to the mandatory rules that let a consumer bring proceedings in their own country. Consumers in the European Union may also use the European Commission’s online dispute resolution platform (ec.europa.eu/consumers/odr). We are not obliged to take part in alternative dispute resolution but will consider it in good faith.
